We’ve made important updates to Yousign’s Terms and Conditions, Privacy Policy, and Data Processing Addendum (DPA) to improve transparency and clarify key aspects of our services.

What updates have been made to our Terms and Conditions?
Several articles have been updated:
Article 3.2 on Subscription: you can subscribe to Yousign new Verification Service without having to subscribe to the Electronic Signature Service. When a subscription to an additional Service requires prior subscription to another Service, this is specified during the subscription process or in the Quote.
Article 3.6 on Subscriber responsibilities during the subscription process and Article 6.3 on Compliance with law: Subscriber shall inform Yousign in writing of any regulations applicable to the Services and specific to its business or that of its Users. It is not Yousign responsibility to identify them and comply with them.
Article 5 on Guarantees: this clause already provides the obligation for Users not to include any sensitive data (as defined by the GDPR) within the free fields of the Platform. It has been updated to also cover any information subject to specific regulations that restrict its use. It also specifies that the Subscriber shall remain responsible for access to the Documents by the Signatories, particularly after the end of the Contract. The aim is to remind Users and Subscribers of their responsibility regarding the content they share or receive via the Platform.
Article 7.3 damages under Yousign responsibility: we have added a clarification stating that Yousign cannot under any circumstances be held liable for the products or services offered by a Subscriber and/or User through their use of the Platform. We also updated Yousign scope of responsibilities in relation to the checks it performs for identity verification purposes in order to cover the new Verification Service.
Article 9.2 on Special Terms for Services: we have added details describing the new Pre-validation feature which is available for Advanced Electronic Signature and we have removed the clause 9.8 which relates to a specific archiving service which is no longer offered to clients. It does not affect Yousign hosting and storage obligations as part of the Electronic Signature Service.
Article 11 on Term: we have specified that the Subscription is concluded for a fixed term and that it is automatically renewed, unless terminated early by the Subscriber, subject to a notice period that varies depending on the initial term of the Subscription.
What updates have been made to the Privacy Policy?
We have only clarified the way we process B2B data as part of the acquisition and enrichment of our B2B database and the way we monitor the performance of the Platform. These changes do not introduce any new obligations for users. Yousign has also updated the list of data processors accordingly.
What updates have been made to the Data Processing Addendum (DPA)?
The DPA has been updated to add description relating to the new processing induced by Yousign new Verification Service. These changes do not introduce any new obligations for users. Yousign has also updated the list of data processors accordingly.

What is the Data Act Addendum ?
In order to remain compliant with legal and regulatory developments, we have created a Data Act Addendum to cover the new regulatory obligations to which we are subject. This Data Act Addendum supplements the Terms and Conditions.
Will the updated Terms and Conditions take effect immediately or after a delay?
For new customers, the update will take effect from the publication date onward.
For existing customers, a 30-day notice period will apply, as outlined in Article 19.2 of our Terms and Conditions.
Which languages are affected by the latest update on Yousign's Terms and Conditions?
Our Terms and Conditions, definitions, DPA, and privacy policy have been updated in French (FR), English (EN), German (DE), Italian (ITA) and Spanish (ES).
Do bespoke contracts get impacted by this update?
No, this update only applies to new customers and those under standard Terms and Conditions. Customers with bespoke contracts or specific conditions that prevent Yousign from modifying the Terms and Conditions will not be affected by these changes.
Are quotes going to be updated due to the recent changes to Yousign's Terms and Conditions?
No, Quotes won’t need updating, as we’re only updating the content of the URLs, which will remain the same.
Will the same URL be reused with only the content of the Terms and Conditions updated?
Yes, the URL will remain the same; we’re only updating the content on the page. This approach prevents broken links in website flows, quotes, documents, and other references.
We’ll also include the Effective Date ("last updated on:") on the page, along with a link to the previous version.
What happens if a user sends an email to hello@yousign.com?
The user will receive an automated response informing them that Yousign does not monitor this email.
